Traveler Terms & Conditions with Liability Waiver & Release
In participating with AtlasDaughters, LLC (hereinafter “AtlasDaughters” “we,” “us,” “our”) on a travel journey to empower future leaders through philanthropy we require your (“traveler,” “you,” “participant”) consent and agree to the following terms and conditions.
CONTRACT
We draw your attention to the terms and conditions of travel herein, which include all brochures, documents, correspondence, and our Privacy Policy, and form the basis of our legally binding contract with you (“Terms and Conditions” “Agreement”). Before making any payment towards a journey or confirming your intent to participate in a journey with us, you must first ensure that you have asked any questions you may have and have read and understood these Terms and Conditions. PLEASE BE AWARE THAT THESE TERMS AND CONDITIONS CONTAIN WAIVERS OF LIABILITY AS WELL AS WAIVERS OF CLASS ACTION AND VENUE SELECTION AND NOTICE CLAUSES. By making a payment and/or asking us to confirm your journey with us you are accepting all of the Terms and Conditions laid out below and acknowledging that you have read the Terms and Conditions of this legally binding agreement and agree to them. If you do not agree with any part of these Terms and Conditions, you must not make a booking with us or pay us in connection with our journeys.
If you are making a booking as a participant mother (or grandmother) for you and your participant daughter(s) (or granddaughter(s)), you are responsible for sharing these Terms and Conditions with any minors in your care and are financially responsible for the booking(s). We will not be liable for your failure to share these Terms and Conditions with all travelers accompanying you. If you are not the minor’s legal guardian or parent, the minor’s legal guardian or parent will need to separately read, acknowledge, and agree to these Terms and Conditions on behalf of the minor traveler(s) and complete a consent form authorizing the minor traveler to travel without their legal guardian or parent present.
You represent and warrant that (a) you are of sufficient age to use our services and website and can create binding legal obligations in connection with your use, (b) you are legally authorized to act on behalf of those you represent, and accept these Terms and Conditions on their behalf, including, but not limited to, any minor participant, and (c) the information supplied by you, and members of your travel group are true and correct.
VIOLATIONS BY YOU
You agree that any violation of any such terms and conditions may result in (a) the cancellation of your journey with us, (b) your forfeiture of any monies paid for your reservation or purchase, and (c) your being denied access to the applicable journey.
SCOPE/AGENCY
AtlasDaughters does not provide, own, manage, operate, supervise, or control the travel services and products that are or may be provided as part of your journey, such as flights, accommodations, packages, or travel insurance (the “Travel Products”). All Travel Products are contracted through Neverseen Experiences, LLC (“Travel Agency”) and are separately owned, controlled, operated, or made available by independent third parties such as destination management companies, airlines, hotels, cruise lines, and tour operators (the “Suppliers”). AtlasDaughters does not contract with any Suppliers directly or make travel arrangements for any of the Travel Products. Your interaction with any Supplier is at your own risk; AtlasDaughters does not bear any responsibility should anything go wrong with your booking or during your journey. Hence, as the traveler, you agree that AtlasDaughters acts only as a promoter for the journey in connecting the traveler(s) to the opportunity to participate on the journey and connecting the traveler(s) with philanthropic opportunities and trainings. AtlasDaughters shall not be responsible for any act, omission, negligence, bankruptcy, insolvency, or default of any Supplier, company, or person engaged in or responsible for any Travel Products or planning, or otherwise in connection therewith.
BOOKING/PAYMENTS
Once you have completed the application for one of our journeys and you have been approved, we will send an invoice for you and your daughter’s participation in the journey. Upon receipt of this invoice, 50% of the full payment is due to confirm your participation. The remaining 50% is due on or before 90 days prior to your arrival day for the journey. Your full payment will cover the accommodations and services as outlined in your journey itinerary. ALL PAYMENTS ARE NON-REFUNDABLE, with limited exceptions as specifically set forth under the section titled “Non-Operation, Postponement or Cancellation of Journey by Us.” All payments shall be remitted to us via wire, whereby we will then submit payment to the Travel Agency for your Travel Products and services. Any additional products or services received from the Travel Agency beyond what is confirmed in your journey itinerary shall be paid directly to the Travel Agency. Since the Travel Agency will be managing all payments to the third-party Suppliers, we shall not be responsible or liable for any payments made, or not made to any Supplier or for any Travel Product and service handled directly by Travel Agency.
After your booking is confirmed, you will receive a payment confirmation. Upon final payment, you will receive your final itinerary and payment confirmation. Any changes you may make after the initial deposit may incur change fees. Please refer to your agreement with Travel Agency to determine what change fees apply to your journey.
AtlasDaughters journeys include highly customized experiences and unprecedented access designed specifically for our group on a trip-by-trip basis. Given the nature of planning required to organize these itineraries, we cannot offer refunds on deposits or final payments. We recognize that plans change, and unforeseen circumstances may prevent you from traveling, which is why we highly recommend travel protection insurance to cover you should cancellation be necessary.
WIRE PAYMENTS
We only accept wire transfers for all payments received for your journey(s). Prior to wiring funds, please contact us by phone to confirm wire instructions due to an increase in wire-related fraud. We do not accept credit cards. All wire transfers are subject to the terms and conditions of your banking institution. You shall be responsible and solely liable for any and all fees assessed by your banking institution for all wire transfers to AtlasDaughters.
CHANGES
AtlasDaughters reserves the right, if necessary, to substitute other similar Travel Products (including hotels) for any Travel Products listed on your itinerary. Such substitutions may be made at any time and without prior notice. We shall not be held responsible for Supplier over-bookings. Should such occur, we will undertake to find similar accommodations and arrangements in the same area. Such substitutions are at AtlasDaughters’ sole discretion and no refunds will be offered for changes with any Travel Products. Likewise, AtlasDaughters shall not be responsible for any incidental expenses incurred as a result of any changes or cancellations.
CANCELLATIONS BY YOU
Cancellation of travel by you must be made in writing and is effective from the date we receive the written notification. If you choose to cancel, all payments made for your journey are non-refundable and no refund will be made to you by AtlasDaughters. If you purchased additional Travel Products or services not outlined in the journey itinerary provided by AtlasDaughters, and directly from Travel Agency or any Supplier, you will need to contact them and review their terms and conditions to inquire about the applicability of any refunds or credits resulting from your cancellation.
NON-OPERATION, POSTPONEMENT, OR CANCELLATION OF JOURNEY BY US
Participant Minimums
Most journeys and their respective pricing are based on a minimum number of participants. AtlasDaughters makes every effort to ensure that the journeys meet the minimum participant requirements. However, if the journey drops below the minimum number of participants, cancellation of the journey may occur at the sole discretion of AtlasDaughters. In such a case, participants will be advised of the inability to meet the minimum number of participants at least 30 days prior to final payment. AtlasDaughters reserves the right to change the departure date and may offer alternative journey dates or other travel arrangements; some even to accommodate a smaller group of participants. You may choose to accept these arrangements and retain your booking with the new dates or cancel your booking. If you choose to retain your booking, your deposit, and any payments made will be credited toward the new travel dates. Since all payments made to AtlasDaughters are non-refundable, we work diligently to meet the minimum participant requirements. On the rare occasion we are unable to meet the minimum participant requirements to conduct the journey and you are unable to participate in a different journey with us, AtlasDaughters will provide you with a refund for all payments made to AtlasDaughters for the journey less any non-recoverable expenses and non-recoverable deposits paid to Suppliers.
Postponement or Cancellation for Other Reasons
AtlasDaughters reserves the right to cancel or postpone any journey at any time prior to departure due to any force majeure event or significant threat of a force majeure event (as defined in the section titled “Force Majeure”) occurring or set to occur in the location of the journey, in any arriving, departing, or connecting location, or locally as it relates to AtlasDaughters and Travel Agency’s location and ability to perform. Should AtlasDaughters decide to postpone or cancel a journey for these reasons, you will be given the option to retain your booking with new travel dates or receive a refund for all payments made less any non-recoverable expenses and non-recoverable deposits paid to Suppliers.
Additional Expenses Incurred
Should your journey be postponed or cancelled by us, AtlasDaughters will not be liable for any additional costs incurred outside of the journey prices such as visa, passport fees, travel insurance, non-refundable flights, or any other purchases made by any participant in anticipation of the booked journey. For this reason, we highly recommend booking changeable flight fares and purchasing travel protection insurance.
NO REFUND FOR UNUSED ARRANGEMENTS
Likewise, as AtlasDaughters’ prices are based on contract rates, there will not be any refund for any unused portion of a travel booking. If you cancel while your journey is in progress, there is no refund for the unused portion.
TRAVEL INSURANCE
Travel protection insurance is not included in your booking with us. However, it is the traveler’s responsibility to protect their purchases. For this reason, travel insurance and additional “cancel for any reason” coverage insurance is strongly recommended. Such a plan should cover Trip Cancellation or Interruption, Medical Expenses, Emergency Evacuation/Repatriation, and Baggage. Travel insurance protection plans can help protect you in the event of loss of non-refundable journey deposits and payments that result from cancellation or trip interruption (due to a covered reason such as injury or illness before or during the journey). It also helps with reimbursement for medical emergency costs (including very costly evacuation costs), missed connections, and baggage loss. Travel protection insurance plans including “cancel for any reason” coverage must be purchased in conjunction with your booking. Atlas Daughters is not qualified to answer technical questions about the benefits, exclusions, and conditions of travel insurance plans. AtlasDaughters cannot evaluate the adequacy of the prospective insured’s existing insurance coverage. If you have any questions about your travel protection insurance, call your insurance broker.
Certain countries have a requirement for foreign visitors to have valid medical insurance on entry. AtlasDaughters cannot be held responsible for denied entry if a traveler is unable to provide details to authorities of insurance of denial of entry for any reason. If you choose to travel without adequate coverage, we will not be liable for any of your losses however arising, for which trip protection insurance coverage would otherwise have been available.
NO GUARANTEES
AtlasDaughters makes no promises or guarantees that any celebrity participant will attend the travel journey in part, or in whole, on any particular itinerary. While we will make every available effort to confirm the celebrity participant, their availability and appearance is ultimately outside of our control. In the event a celebrity does not attend or participate in your travel journey, we shall not be liable for any refund to you or anyone traveling with you.
FORCE MAJEURE
AtlasDaughters assumes no liability for any loss, damage, delay, or cancellation resulting in whole or in part from an Act of God or any other force majeure condition, including, without limitation: fire, volcanic eruption, hurricane, environmental pollution or contamination, inclement weather, earthquake, low or high water levels, flood, water or power shortages or failures, tropical storms or hurricanes, riots or civil commissions or disturbances, or any other acts of a similar nature, sabotage, arrests, strikes or labor disruptions, restraint of rulers or peoples, expropriations, acts of terrorism, war, insurrection, quarantine restrictions, government health advisories, epidemics, pandemics (including, without limitation, COVID-19), or warnings or alerts of any kind of nature, government seizures, refusal or cancellation or suspension or delay of any government authority or any license, permit or authorization, damages to its facilities or the travel supplier and its facilities, or any other unforeseen circumstances or any other factors unforeseen by AtlasDaughters that impacts negatively on, or hampers, its ability to fulfill any of its contractual conditions (“force majeure”). In circumstances amounting to force majeure, we will not be required to refund any money to you, although if (and only if) we can recover any monies from our Suppliers (it being under no obligation to do so), we will refund these to you without any charge by AtlasDaughters.
NON-RESPONSIBILITY
AtlasDaughters, its employees, members, managers, agents, and representatives create these mother/daughter travel journeys to expose daughters to philanthropy and world travel, while serving various non-profit organizations in their efforts to contribute to meaningful change. In doing so, we contract with an independent travel agency who plans, books, and organizes the various travel components necessary to provide the journey opportunities to you and other travelers. We rely on the Travel Agency to vette suppliers, perform their proper due diligence, and to secure all travel accommodations and services. AtlasDaughters is an independent contractor and is not an employee, agent, or representative of any of the Travel Agency or any of the third-party Suppliers. AtlasDaughters does not own, manage, operate, supervise, or control any transportation, vehicle, airplane, hotel or restaurant, Travel Agency, or any other entity that supplies services related to your journey. All Suppliers are independent contractors and are not agents, owners, employees, or representatives of AtlasDaughters. All tickets, receipts, coupons, and vouchers are issued subject to the terms and conditions specified by each supplier, and by accepting the coupons, vouchers, and tickets, or utilizing the services, all travelers agree that neither AtlasDaughters, nor its employees, members, managers, agents, or representatives are or may be liable for any loss, injury, or damage to any traveler or their personal belongings, or otherwise, in connection with any part of the journey supplied or not supplied resulting directly or indirectly from any occurrence beyond the control of AtlasDaughters. AtlasDaughters assumes no responsibility or liability for any delay, change in schedule, loss, injury or damage or loss of any traveler that may result from any act or omission on the part of others; AtlasDaughters assumes no responsibility or liability for personal property; and AtlasDaughters shall be relieved of any obligations under these Terms and Conditions in the event of any strike, labor dispute, act of God, or of government, fire, war, whether declared or not, terrorism, insurrection, riot, theft, pilferage, epidemic, pandemic, illness, physical injury, quarantine, medical or customs or immigration regulation, delay, or cancellation. AtlasDaughters accepts no responsibility for lost or stolen items. AtlasDaughters reserves the right to refuse any traveler or potential traveler at its sole discretion.
ASSUMPTION OF RISK/WAIVER
Traveler is aware that travel to such area as traveler is undertaking on the journey may involve inherent risks, some in remote areas of the world. Inherent risks include, but are not limited to, risk of injury or death from: motor vehicles collisions, animals, roadway hazards, slips, and falls, criminal or terrorist acts, government actions, consumption of alcoholic beverages, tainted food, or non-potable water; exposure to the elements, including heat, cold, sun, water, and wind; your own negligence and/or the negligence of others, including tour guides, other travelers, AtlasDaughters and its employees, agents, members, managers, and/or representatives; attack by or encounter with insects, reptiles, and/or animals; accidents or illness occurring in remote places where there are no available medical services; fatigue, chill, overheating, and/or dizziness; known or unknown medical conditions, COVID-19 and other diseases, physical excursion for which you are not prepared or other such accidents; the negligence or lack of adequate training of any third-party providers who seek to assist with medical or other help either before or after injuries have occurred; accident or illness without access to means of rapid evacuation or availability of medical supplies or services; and the adequacy of medical attention once provided.
Traveler understands the description of these risks is not complete and that unknown or unanticipated risks may result in injury, illness, or death. In order to partake of the enjoyment and excitement of this journey and in consideration of the details of the journey itself provided by AtlasDaughters, the traveler is willing to accept the risks and uncertainty involved as being an integral part of travel, including the risk of infection, illness, and death. Traveler hereby accepts and assumes full responsibility for any and all risks of illness, injury or death and of the negligence of AtlasDaughters and agrees to and shall hold harmless and fully release AtlasDaughters, and its employees, members, managers, agents, and representatives (“Representatives”) from any and all claims associated with the journey, including any claims of third party negligence and/or the negligence of AtlasDaughters and/or its Representatives, and traveler hereby covenants not to sue AtlasDaughters and/or its Representatives for any such claims or join any lawsuit or action that is suing AtlasDaughters. This agreement also binds your heirs, legal representatives, and assigns. The terms of this HOLD HARMLESS AND RELEASE OF ALL LIABILITY paragraph shall survive any termination or cancellation of these Terms and Conditions, whether by operation of law or otherwise.
MEDICAL TREATMENT
If medical treatment is necessary as a result of my participation in the journey, travel to and from the journey, or any events incidental to this journey, traveler agrees to be fully financially responsible for any costs incurred as a result of such treatment for herself and any minor traveling with her and to assume full responsibility for any treatment or lack of adequate treatment received.
INDEMNIFICATION
Each traveler is expected to act responsibly and adhere to all behavior guidelines established by AtlasDaughters, its Representatives, the Travel Agency, and Suppliers. Our Representatives, the Travel Agency, and Suppliers, each individually, reserve the right to remove you and anyone traveling with you from the journey if you endanger yourself or others or inappropriately disrupt others. No refund will be offered or owed if you are removed from the journey due to your failure to abide by the behavior guidelines.
Traveler agrees to and shall indemnify and hold harmless AtlasDaughters and its Representatives from any expenses, losses, liabilities, damages, judgments, settlements, and costs (collectively, “damages”) involved with or incurred by AtlasDaughters or its Representatives (including, without limitation, reasonable attorneys’ fees and costs and the advancement of same) with respect to any claims, lawsuits, arbitrations, or other causes of action, which result, directly or indirectly, from: (i) traveler’s breach or violation, or threatened breach or violation, of these Terms and Conditions and (ii) any damage caused by traveler while participating in the journey. The terms of this INDEMNIFICATION paragraph shall survive any termination or cancellation of this Contract, whether by operation of law or otherwise.
YOUR BEHAVIOR
Each traveler on any journey planned by AtlasDaughters is expected to act responsibly and adhere to all behavior guidelines established by AtlasDaughters, the Travel Agency, and Suppliers. AtlasDaughters and Suppliers reserve the right to remove you and any minor(s) traveling with you from any facility, hotel or resort property, tour location, or means of transportation if your health or your conduct appears to endanger yourself or others, disrupts the general well-being of other individuals on any element of your journey, or interferes with the operation or security of the places we visit. There will be no refund.
When you book with AtlasDaughters, you accept responsibility for any damage or loss caused by you and any minor(s) traveling with you. Full payment for any such damage or loss (reasonably estimated if not precisely known) must be paid directly at the time to the accommodation owner or manager or other Supplier. You must indemnify us for the full amount of any claim (also including legal costs) made against us. We are not responsible for any costs incurred concerning a guest removed from a journey, or any portion of a journey. You agree not to hold AtlasDaughters or any of its related entities liable for any actions taken under these Terms and Conditions. Baggage and personal effects are at all times the sole responsibility of traveler(s). This clause shall survive termination of these Terms and Conditions.
PHOTOGRAPHIC/VIDEO LIKENESS
Traveler hereby gives consent and grants to AtlasDaughters a royalty-free, perpetual, and irrevocable license to publish any photographs and/or videos obtained during the journey of traveler and any minor(s) participating in the journey with traveler in printed or electronic media without obtaining further consent and without compensation. Each Traveler waives any rights, claims, or interests and releases AtlasDaughters and its representatives from any liability in connection with any use of such photographs and/or video used.
PRIVACY
While we make every effort to protect your privacy and maintain your personal information, we do share your personal information, including, but not limited to, your name, address, date of birth, passport information, and any other information we may need to secure your journey booking with Travel Agency. In addition, we form partnerships with various organizations, and suppliers (“Partners”) in an effort to raise additional funds for the non-profits we are serving. We do not share personal information about our travelers with any of our Partners. Details regarding how we manage your personal information can be found in our Privacy Policy on our website.
GOVERNING LAW/SUBMISSION TO JURISDICTION
These Terms and Conditions and all attachments hereto and the rights of the parties hereunder shall be governed by and construed in accordance with the laws of the State of California exclusive of conflict or choice of law rules. Any claims shall be brought in a court of competent jurisdiction located in Placer County, California, or if brought in federal court, before the U.S. District Court located in the Eastern District of California.
JURY WAIVER, LIMITED DAMAGES, STATUTE OF LIMITATIONS & NOTICE OF CLAIM
You agree that you will only bring claims against AtlasDaughters in your individual capacity and not as a plaintiff or class member in any purported class action or representative proceeding. AtlasDaughters shall not in any case be liable for other than compensatory damages, and any payment made to us shall mean that you agree to these Terms and Conditions of sale and expressly waive any right to punitive damages. YOU UNDERSTAND AND AGREE THAT NO CLAIMS WILL BE CONSIDERED AND THAT YOU WILL NOT BRING SUIT AGAINST ATLASDAUGHTERS UNLESS YOU HAVE FIRST PROVIDED A TYPEWRITTEN NOTICE OF CLAIM TO ATLASDAUGHTERS WITHIN 30 DAYS AFTER THE JOURNEY OR CANCELLATION OF THE JOURNEY, FURTHER PROVIDED THAT YOU AGREE TO FILE SUIT WITHIN ONE (1) YEAR OF THE INCIDENT AND YOU ACKNOWLEDGE THAT THIS EXPRESSLY LIMITS THE APPLICABLE STATUTE OF LIMITATIONS TO ONE (1) YEAR.
ENTIRE AGREEMENT & SEVERABILITY
These Terms and Conditions and any other documents, including invoices, that we provide you constitutes the entire agreement, and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, with respect to AtlasDaughters. If any provision of these Terms and Conditions shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.
I acknowledge that I have read, understand, and agree to all of the foregoing legally binding Terms and Conditions applicable to my travel with AtlasDaughters, LLC. I freely enter into this Agreement and understand the legal consequences of entering into this Agreement and intend to be bound by its terms.

BOOKING TERMS & CONDITIONS
Please read the following terms and conditions carefully, together with our Privacy Policy. All other documents and communications provided by Neverseen constitute the entire agreement between the parties and form a legally binding contract upon payment. Submission of payment to Neverseen signifies the acceptance of the Terms & Conditions of Sale.
Neverseen is a travel company trading as Neverseen Experiences LLC (EIN 92-2208659). Our registered office is at 6345 Balboa Blv, Suite 375, Encino, CA 91316. We are travel and lifestyle consultants for private, tailor-made experiential journeys across the globe. The terms "we", "us", "our", and “Neverseen" refer to Neverseen Experiences LLC. The term "you", “traveler” or “client” refers to the customer booking the travel package. Before making any payment towards a journey or confirming your intent to participate in a journey with us, you must first ensure that you have asked any questions you may have and have read and understood these Terms and Conditions. PLEASE BE AWARE THAT THESE TERMS AND CONDITIONS CONTAIN WAIVERS OF LIABILITY AS WELL AS WAIVERS OF CLASS ACTION, VENUE SELECTION AND NOTICE CLAUSES. By making a payment and/or asking us to confirm your journey with us you are accepting all of the Terms and Conditions laid out below and acknowledging that you have read the Terms and Conditions of this legally binding agreement and agree to them. If you do not agree with any part of these Terms and Conditions, you must not make a booking with us or pay us in connection with our journeys.If you are booking a travel package for another person you agree to inform that person(s) about the Terms & Conditions that apply to the booking you have made on their behalf, including all rules and restrictions applicable thereto and these Terms of Use. You also warrant that all information supplied by you or on your behalf, or by members of your party is true, current, complete and accurate.
If you are making a booking as a legal guardian of a participating minor, you are responsible for sharing these Terms and Conditions with any minors in your care and are financially responsible for the booking(s). We will not be liable for your failure to share these Terms and Conditions with all travelers accompanying you. If you are not the minor’s legal guardian or parent, the minor’s legal guardian or parent will need to separately read, acknowledge, and agree to these Terms and Conditions on behalf of the minor traveler(s) and complete a consent form authorizing the minor traveler to travel without their legal guardian or parent present.
AGENCY SCOPE & SUPPLIERS
Neverseen does not provide, own, manage, operate, supervise, or control the travel services and products that are or may be provided as part of your journey, such as flights, accommodations, packages, or travel insurance (the “Travel Products”). All Travel Products are contracted from separately owned, controlled, operated, or made available by independent third parties such as destination management companies, airlines, hotels, cruise lines, and tour operators (the “Suppliers”). Your trip constitutes a contract between yourself and the suppliers, even if purchased through Neverseen. Neverseen shall not be responsible for any act, omission, negligence, bankruptcy, insolvency, or default of any Supplier, company or person engaged in or responsible for any Travel Products or planning, or otherwise in connection therewith. All bookings are subject to the laws of the country in which such carriage or other facility or service is provided.
PRICING
Travel packages are quoted in US Dollars, per person and based on double occupancy, except where indicated otherwise. These quotes are valid for seven (7) days from the date the quote is sent. Please note the payment schedules and percentages outlined may vary from the standard booking procedures below according to the policies required by our suppliers. Any exceptions will be clearly detailed in the body of an email at the time of reservation.
Due to confidential agreements with Suppliers, Neverseen is under no obligation to provide a breakdown of the costs of any travel itinerary or services. Any modifications to a travel itinerary, including dates or number of people traveling, will require a revised proposal. Single travelers are often required to pay a single supplemental fee.
Trip Planning Fees
Neverseen reserves the right to charge a non-refundable planning fee before the planning of a trip begins. Depending on trip length or complexity, a non-refundable fee of $500-$2000 per week of travel is chargeable on bookings made for non-repeat travelers or travel agents. When the trip is confirmed, the fee will be applied toward the booking total. If the client decides not to confirm the fee is non-refundable.
STANDARD BOOKING PROCEDURES & PAYMENT SCHEDULE
At the time of confirming a booking, a non-refundable deposit is required, consisting of 50% of the total land arrangement amount and 100% of any applicable flights or other non-refundable items. The deposit must be received within five days of receiving the invoice in order to secure reservations and guarantee the quoted rate. Flight prices are not guaranteed and may change until the tickets are issued. The remaining balance is due 90 days before the start date of the travel itinerary. If the booking is made within 90 days of the start date of the travel itinerary, a full 100% payment is due. If payment is not received by the due date, flights, hotels, transportation, and all other reservations will be canceled. Neverseen is not responsible for any penalties, fare increases, or fees incurred due to late payment. ALL PAYMENTS ARE NON-REFUNDABLE.
Wire Payments
We only accept wire transfers for all payments received for your journey(s). Prior to wiring funds, please contact us by phone to confirm wire instructions due to an increase in wire-related fraud. We do not accept credit cards. All wire transfers are subject to the terms and conditions of your banking institution. You shall be responsible and solely liable for any and all fees assessed by your banking institution for all wire transfers to Neverseen.
PACKAGE EXCLUSIONS
Unless specifically noted, travel packages do not include; (i) travel insurance (ii) international airfare (iii) domestic or internal airfare unless otherwise noted (iv) costs associated with obtaining passports, entry visas, or vaccinations (v) reciprocity and other border fees (vi) airport departure taxes (vii) all baggage charges (viii) gratuities (ix) meals other than those specified in the itinerary (x) beverages other than those noted in inclusions above or specified in the itinerary (xi) any meals for your guide if you invite him/her to dine with you (xii) activities, hotels and transportation not included in the itinerary (xiii) personal expenses such as laundry, room service and mini-bar consumptions at hotels (xiv) internet access (xv) additional activities requested during travel (xvi) changes in government-imposed taxes and fees post-booking.
TRAVEL INSURANCE
Travel protection insurance is not included in your booking with us. However, it is the traveler’s responsibility to protect their purchases. For this reason, travel insurance and additional “cancel for any reason” coverage insurance is strongly recommended. Such a plan should cover Trip Cancellation or Interruption, Medical Expenses, Emergency Evacuation/Repatriation, and Baggage. Travel insurance protection plans can help protect you in the event of loss of non-refundable trip deposits and payments that result from cancellation or trip interruption (due to a covered reason such as injury or illness before or during the journey). It also helps with reimbursement for medical emergency costs (including very costly evacuation costs), missed connections, and baggage loss. Travel protection insurance plans including “cancel for any reason” coverage must be purchased in conjunction with your booking. Neverseen is not qualified to answer technical questions about the benefits, exclusions, and conditions of travel insurance plans. Neverseen cannot evaluate the adequacy of the prospective insured’s existing insurance coverage. If you have any questions about your travel protection insurance, call your insurance broker.
Certain countries have a requirement for foreign visitors to have valid medical insurance on entry. Neverseen cannot be held responsible for denied entry if a traveler is unable to provide details to authorities of insurance of denial of entry for any reason. IF YOU CHOOSE TO TRAVEL WITHOUT ADEQUATE COVERAGE, WE WILL NOT BE LIABLE FOR ANY OF YOUR LOSSES HOWEVER ARISING, FOR WHICH TRIP PROTECTION INSURANCE COVERAGE WOULD OTHERWISE HAVE BEEN AVAILABLE.
AIRFARE
International airfare (to the travel itinerary starting point and from the ending point) is not included in the travel package. Some travel itineraries require domestic flights as specified in the itinerary. This airfare is typically not included and must be purchased from Neverseen in addition to the travel itinerary unless otherwise specified. In the instance where flights proposed in the itinerary are no longer available, Neverseen reserves the right to substitute and confirm air reservations on a suitable alternative. All domestic air is 100% non-refundable at the time of final payment. All international and domestic airfare quotes are subject to change in fare and availability until final payment and passport copies of each traveler have been received by Neverseen.
All air carriers are independent contractors and are not owned, managed, controlled, or operated by Neverseen. Your airline ticket constitutes a contract between yourself and the airlines, even if purchased through Neverseen. Please check with your international carrier for other baggage restrictions and fees applicable to your domestic and international flights. Unless specifically stated in your itinerary, rates do not include Airline baggage or seat assignment fees or other ancillary fees related to your airborne journey. Neverseen is not liable for, and does not assume responsibility or accept claims with regard to: seat assignments, name changes, schedule changes, flight changes and/or cancellations. Should you change or cancel your air transportation arrangements before or after your travel begins, all airline change and cancellation fees will apply.
Baggage and personal effects are at the owner’s risk throughout the travel itinerary, and Neverseen assumes no liability for lost or damaged baggage. Therefore, you are urged to purchase travel insurance that includes provisions for your baggage. Please check with your international carrier for other baggage restrictions and fees applicable to your international flight.
OPTIONAL ACTIVITIES
During a booked Neverseen itinerary, there may be opportunities to participate in activities or local events, which are not included in Neverseen’s travel package. Neverseen makes no representations about the safety or quality of these activities or the standard of the independent operator running it. You accept that any additional assistance given by your group leader, host, guide or local representative in arranging optional activities does not render Neverseen liable for them in any way. The contract for the provision of that activity will be between you and activity provider, Neverseen will have no liability for your participation in such activities and you will be bound by the terms and conditions of the independent operator.
VISAS & DOCUMENTATION
It is the customer’s responsibility to verify current entry requirements and obtain/pay for the necessary travel documentation (visas, reciprocity fees, affidavits, immunizations, etc.) based on the country of origin, destination, and any countries in which a stop is scheduled. For up-to-date detailed information on travel documents and visas, entry/exit taxes and further information on entry and exit requirements please check with your local consular services. By offering travel packages in particular international destinations, Neverseen does not represent or warrant that travel to such areas is advisable or without risk. It is your responsibility to stay informed about the areas to which you will be traveling, including any travel advisories and warnings issued by your country’s government. You are responsible for protecting your own well-being and personal property before, during, and after your booked travel itinerary. Neverseen will not be liable for damages or losses that result from travel to such destinations.
It is the customer’s responsibility to carry and verify that a passport is valid at the time of departure, remains valid for a minimum of 6 months beyond the return travel date, and contains sufficient blank pages to attach any required visas for their travel. Some countries may require that children under 18 years of age must travel with the consent of both parents. Please verify the most current documentation and entry requirements with the country’s consulate, an immigration office or at travel.state.gov. No refund will be issued for losses incurred as a result of failure to obtain or provide required valid documentation.
ITINERARY CHANGES
No Guarantees
Neverseen makes no promises or guarantees that any celebrity participant will attend the travel journey in part, or in whole, on any particular itinerary. While we will make every available effort to confirm the celebrity participant, their availability and appearance is ultimately outside of our control. In the event a celebrity does not attend or participate in your travel journey, we shall not be liable for any refund to you or anyone traveling with you.
Itinerary Changes by Neverseen
Neverseen reserves the right, if necessary, to substitute other similar Travel Products (including hotels) for any Travel Products listed on your itinerary. Such substitutions may be made at any time and without prior notice. Such substitutions are at Neverseen’s sole discretion and no refunds will be offered for changes with any Travel Products. Likewise, Neverseen shall not be responsible for any incidental expenses incurred as a result of any changes or cancellations.
Itinerary Changes by the Traveler
Neverseen will always try their best to accommodate any client requests. Any changes you may make after the initial deposit may incur change fees. Changes in travel arrangements that result in additional monies owed due to price differences, fuel surcharges, ticket re-issuance fees, etc. are due and payable directly to Neverseen at the time of change.
SCHEDULED GROUP DEPARTURES
Participant Minimums
Neverseen will occasionally organize group departures requiring public buy-in. Pricing for these trips is based on the number of participants. Neverseen makes every effort to ensure that the journeys meet the minimum participant requirements. However, if the journey drops below the minimum number of participants, cancellation of the journey may occur at the sole discretion of Neverseen. In such a case, participants will be advised of the inability to meet the minimum number of participants at least 30 days prior to final payment. Neverseen reserves the right to change the departure date and may offer alternative journey dates or other travel arrangements; some even to accommodate a smaller group of participants. You may choose to accept these arrangements and retain your booking with the new dates or cancel your booking. If you choose to retain your booking, your deposit, and any payments made will be credited toward the new travel dates. Since all payments made to Neverseen are non-refundable, we work diligently to meet the minimum participant requirements. On the rare occasion we are unable to meet the minimum participant requirements to conduct the journey and you are unable to participate in a different journey with us, Neverseen will provide you with a refund for all payments made to Neverseen for the journey less any non-recoverable expenses and non-recoverable deposits paid to Suppliers.
Additional Expenses Incurred
Should your journey be postponed or canceled by us, Neverseen will not be liable for any additional costs incurred outside of the journey prices such as visa, passport fees, travel insurance, non-refundable flights, or any other purchases made by any participant in anticipation of the booked journey. For this reason, we highly recommend booking changeable flight fares and purchasing travel protection insurance. We also recommend - and sometimes require - that travelers purchase travel insurance that covers cancellations or changes in plans to mitigate potential losses.
CANCELLATION
Cancellation by the Traveler
Any cancellation by the traveler must be requested in writing and must be acknowledged by Neverseen in writing. The cancellation will become effective on the date of acknowledgment by Neverseen. The following standard charges apply from the date before departure within which written cancellation is received by us:
Upon booking – 50% of invoice total plus cost of non-refundable items such as airfare or private charters. 90 to 0 days: 100% of invoice total.
All domestic and international airfares and private charters are 100% non-refundable at the time of final payment. Should you change or cancel your air transportation arrangements before or after your travel begins, all airline change and cancellation fees will apply. A re-booking admin fee of $250 per person may also be applied by Neverseen. Likewise, as Neverseens’ prices are based on contract rates, there will not be any refund for any unused portion of a travel booking. If you cancel while your journey is in progress, there is no refund for the unused portion.
Postponement or Cancellation for Other Reasons
Neverseen reserves the right to cancel or postpone any journey at any time prior to departure due to any force majeure event or significant threat of a force majeure event (as defined in the section titled “Force Majeure”) occurring or set to occur in the location of the journey, in any arriving, departing, or connecting location, or locally as it relates to Neverseen and Travel Agency’s location and ability to perform. Should Neverseen decide to postpone or cancel a journey for these reasons, you will be given the option to retain your booking with new travel dates or receive a refund for all payments made less any non-recoverable expenses and non-recoverable deposits paid to Suppliers.
Force Majeure
Neverseen assumes no liability for any loss, damage, delay, or cancellation resulting in whole or in part from an Act of God or any other force majeure condition, including, without limitation: fire, volcanic eruption, hurricane, environmental pollution or contamination, inclement weather, earthquake, low or high water levels, flood, water or power shortages or failures, tropical storms or hurricanes, riots or civil commissions or disturbances, or any other acts of a similar nature, sabotage, arrests, strikes or labor disruptions, restraint of rulers or peoples, expropriations, acts of terrorism, war, insurrection, quarantine restrictions, government health advisories, epidemics, pandemics (including, without limitation, COVID-19), or warnings or alerts of any kind of nature, government seizures, refusal or cancellation or suspension or delay of any government authority or any license, permit or authorization, damages to its facilities or the travel supplier and its facilities, or any other unforeseen circumstances or any other factors unforeseen by Neverseen that impacts negatively on, or hampers, its ability to fulfill any of its contractual conditions (“force majeure”). In the circumstances amounting to force majeure, we will not be required to refund any money to you, although if (and only if) we can recover any monies from our Suppliers (it being under no obligation to do so), we will refund these to you without any charge by Neverseen.
Credits
In certain circumstances, at our discretion, we may offer a credit for future travel with us. All credits are subject to the terms and conditions of our local suppliers and partners. Our ability to offer such credits is contingent upon their policies and be in alignment with their guidelines in these exceptional instances. Should such a credit be issued, it must be utilized within one year from the date of issuance. This provision is designed to accommodate our travelers in exceptional situations, allowing them the flexibility to reschedule their journey within a designated timeframe. Credits not redeemed within this period will be forfeited.
MEDICAL TREATMENT
If medical treatment is necessary in the journey or any events incidental to this journey, the traveler agrees to be fully financially responsible for any costs incurred as a result of such treatment for herself and any minor traveling with her and to assume full responsibility for any treatment or lack of adequate treatment received.
PERSONAL RESPONSIBILITY
Each traveler is expected to act responsibly and adhere to all behavior guidelines established by any partner supplier or accommodation. You shall hereby defend, indemnify, and hold Neverseen harmless against any, and all third-party claims arising out of any conduct or omission in breach of these terms and conditions or that otherwise creates liability for Neverseen.
Some of Neverseen trips are intentionally designed to take clients “off the beaten path” to places where facilities, infrastructure, safety and other standards may not be sophisticated and may be different from those in a traveler’s home country. Trips involve physical activity that can be demanding, depending on the condition of the traveler, and the risk of serious personal injury, including permanent disability and death from accident, illness, or the actions or negligence of other persons. Medical facilities and services may not be easily accessible and may not be sophisticated.
The traveler acknowledges that he/she is aware that travel such as the journey he/she is undertaking involves potentially dangerous activities, some in remote areas of the world, with a risk of illness, injury or death which may be caused by forces of nature, illness, or by the willful or criminal conduct of third parties or by terrorism. The participant further acknowledges that weather conditions may be severe and/or adverse, and that medical services or facilities may not be readily available or accessible or with quality standards that exist in countries such as the United States or Europe.
COMPLAINTS
We will always endeavor to resolve any complaints on the spot. Any complaint whilst on holiday must be voiced to the person in charge of providing the service, and to any local representative of Neverseen.
CUSTOMER IDENTIFICATION & PROOF OF CITIZENSHIP
The Transportation Security Administration (TSA) requires all airline passengers traveling on and after November 1, 2010 to provide the following Secure Flight Passenger Data (SFPD) regardless of when the reservation was booked:
Full Name as it Appears on Government-Issued Passport Date of Birth
Gender Names provided to Neverseen for customers must be an exact match to the passport that will be used during travel. The customer is responsible for all fees and expenses that may be incurred due to an incorrect name, or to the denial of travel due to an incorrect name. A name revision fee of $50 per person will be assessed by Neverseen for name corrections or revisions, in addition to other fees assessed by airlines or other suppliers. Updated information regarding security measures and requirements for air travel are available at www.tsa.gov. It is highly recommended for the customer to check this website for possible changes due to security measures and air travel for their scheduled destination(s).
APPLICABLE LAW AND VENUE
The State of California law governs these Terms and Conditions to the fullest extent allowable. Any disputes in connection with a Neverseen travel package or these Terms and Conditions will be initiated in the Superior Courts of the State of California where exclusive jurisdiction and venue reside. If a court or any other appropriate authority finds any portion of this document to be invalid, the remainder will remain in full force and effect. All client claims must be submitted in writing and received by Neverseen no later than thirty (30) days after the completion the booked travel itinerary. Client claims not submitted and received within this time shall be deemed waived and barred.
JURY WAIVER, LIMITED DAMAGES, STATUTE OF LIMITATIONS & NOTICE OF CLAIM
You agree that you will only bring claims against Neverseen in your individual capacity and not as a plaintiff or class member in any purported class action or representative proceeding. Neverseen shall not, in any case, be liable for other than compensatory damages, and any payment made to us shall mean that you agree to these Terms and Conditions of sale and expressly waive any right to punitive damages. YOU UNDERSTAND AND AGREE THAT NO CLAIMS WILL BE CONSIDERED AND THAT YOU WILL NOT BRING SUIT AGAINST NEVERSEEN UNLESS YOU HAVE FIRST PROVIDE A TYPEWRITTEN NOTICE OF CLAIM TO NEVERSEEN WITHIN 30 DAYS AFTER THE JOURNEY OR CANCELLATION OF THE JOURNEY, FURTHER PROVIDED THAT YOU AGREE TO FILE SUIT WITHIN ONE (1) YEAR OF THE INCIDENT AND YOU ACKNOWLEDGE THAT THIS EXPRESSLY LIMITS THE APPLICABLE STATUTE OF LIMITATIONS TO ONE (1) YEAR.
UPDATING BOOKING TERMS & CONDITIONS
Neverseen reserves the right to update and/or alter these Booking Terms & Conditions at any time at Neverseen sole discretion without notice. It is the client’s responsibility to be familiar with them. The latest Booking Terms & Conditions can always be found on the Neverseen website www.neverseen.travel and will supersede any previous versions.
LIABILITY WAIVER & RELEASE
Neverseen does not own or operate any entity which is or does provide goods or services for your booked travel package including, for example, ownership or control over hotels or other lodging facilities, airline, vessel, bus, van, or other transportation companies, local ground operators, providers or organizers of optional excursions, food service or entertainment providers, etc. Neverseen acts as an agent and is not an employee of any of these suppliers. Neverseen does not own, manage, operate, supervise, or control any transportation, vehicle, aeroplane, hotel, restaurant, or any other entity that supplies services related to your tour. All suppliers are independent contractors, and are not agents or employees or representatives of Neverseen. All reservations are subject to the terms and conditions specified by each supplier. By utilizing the services, all customers agree that Neverseen is not responsible for any injury, loss, or damage to person or property, death, delay, or inconvenience in connection with the provision of any goods or services occasioned by or resulting from, but not limited to, acts of nature, acts of God, acts of war or civil unrest, insurrection or revolt, strikes or other labour activities, criminal or terrorist activities of any kind, insurrection, riot, theft, pilferage, epidemic, illness, physical injury, quarantine, medical or customs or immigration regulation, delay, or cancellation. Neverseen accepts no responsibility for lost or stolen items. Neverseen reserves the right to refuse any client or potential client at its sole discretion.
LIMITATION OF LIABILITY
By making a reservation, the customer acknowledges that in all events Neverseen shall not be liable for any incidental or consequential damages and that the sole extent of Neverseen liability, if any, shall never exceed the total commissions gained from the amount actually paid by the customer to Neverseen.
ACCEPTANCE OF RISK & WAIVER
The Traveler is responsible for purchasing the type of travel package that fits his desired comfort level and participating in activities that are suitable for your fitness level and capabilities. Neverseen will customize your travel package based on the personal information and preferences you provide to the company. By making a booking, you acknowledge that Neverseen’s travel itineraries are adventurous by nature and may involve a significant amount of personal risk. You are aware that travels such as those which you are undertaking involve hazardous activities, some in remote areas of the world, with a risk of injury or death which may be caused by forces of nature, the negligence of Neverseen, or other persons and companies known or unknown, or of willful or criminal conduct of third parties. Additional risks and dangers may arise including, but not limited to, hazards of travel by train, automobile, motor coach, aircraft and other means of conveyance, mechanical or other failure of aeroplanes or other means of transportation, structural or other defective conditions in hotels or other lodging facilities, animal interactions, marine life, or vegetation of any sort, dangers incident to recreational activities such as scuba diving, snorkelling, swimming, kayaking, sailing, canoeing, rafting, hiking, bicycling, rock climbing, etc., sanitation problems, food poisoning, lack of access to or quality of medical care, difficulty in evacuation in case of medical or other emergency, forces of nature, political unrest, other unrest, risks associated with water, food, plants, insects and differing animal regulation, and acts of national and local governments and unrest and acts of others against governments,. These risks are not an exhaustive list but are examples of many kinds of risks. You are voluntarily participating in these activities with the knowledge that there are significant dangers involved, and you hereby agree to accept any and all risks. You are also aware that medical services or facilities may not be readily available or accessible during some or all of the time during which you are participating in this trip. You accept these risks and obligations and fully assume the risks of travel and work in this type of environment. You fully and forever release and discharge Neverseen and all other related, affiliated, associated or otherwise connected corporations, partnerships, individuals and other entities and all of their respective officers, directors, employees, contractors, agents, successors and assigns (collectively, the “Releasees”) from any and all costs (including, without limitation, actual legal costs), claims, demands, actions, causes of action and liabilities whatsoever for any and all losses, damages, death or injuries to persons or loss of property, which may be sustained by you in connection with or in any way relating to this trip, due to any cause or reason whatsoever including, without limitation, the reckless, willful or negligent actions or omissions of the Releasees or any other person or persons.
MINOR PARTICIPANT WAIVER & RELEASE
PLEASE READ CAREFULLY BEFORE SIGNING. I, (hereinafter “parent or legal guardian”, “you”, “I”), certify that I am above the age of 18 years old and have the legal right to sign this Minor
Participant Waiver & Release (“Minor Waiver”) on behalf of the minor child/ren listed below. As consideration for my minor child/ren (under 18 years of age) or ward’s (‘Minor Participant”) participation in the journey with Neverseen Experiences, LLC (“Neverseen”), including any transportation to and from the journey, I hereby attest that after reading this Minor Waiver completely and carefully I acknowledge, appreciate, and willingly agree to the following:
I understand and agree on behalf of Minor Participant that Neverseen is merely creating the journey and providing some components as they relate to the non-profit service opportunities for the journey. All other accommodations, travel products, and services are being made available to me through my booking by third-party suppliers (“Suppliers”).
I understand that participation in this journey could expose her to risk of personal injury, illness, death, or property damage and acknowledge that she is voluntarily participating in this journey and assuming all risks arising from such travel including injury, illness, death, damage, or loss of property arising out of, or in connection with her participation in the journey from whatever cause.
In consideration for her willing participation in the journey, I agree to hold Neverseen harmless from any and all claims, including but not limited to, attorneys’ fees and costs that may occur as a result of her participation in the journey including any travel to or from the journey.
I hereby release Neverseen from all liability and promise not to sue Neverseen, its managers, members, agents, assigns, contractors, and representatives (collectively “Representatives”) from any and all claims, including Representative’s negligence that results in any illness, property damage, injury, economical or emotional loss, or death that minor may suffer as a result of participating and/or traveling to/from the journey.
I understand and intend this document, as written, to be as broad and inclusive as legally permitted by the State of California. If any clause or term is considered to be invalid or unenforceable for any reason, I will continue to be bound by all remaining provisions and terms.
I have fully read and understand the Traveler Terms and Conditions & Waiver of Liability (“Terms and Conditions”) as it applies to me and understand and fully agree that the same Terms and Conditions shall apply to Minor Participant. No other representations shall apply beyond the terms specified in this Minor Waiver and the Terms and Conditions.
PRIVACY POLICY
This privacy policy will set out how Neverseen Experiences LLC handles any personal information that you make available to us whilst planning trips with us.
INFORMATION WE MAY COLLECT FROM YOU
We will collect information from you through our online inquiry form, over the phone when you call, and when you send emails and other forms of messaging. In order to initiate a request with us we will need your First name, Last name, Email address, Telephone number. Upon booking with us it may be necessary for us to collect further personal information in order to reserve flights, hotel rooms, tours etc. These details may include; Home Address, Credit Card details, Date of birth, Passport number, Passport copy, and Frequent flyer numbers. To further personalize your trip, we may also ask for information on personal preferences, special dietary requirements and physical health.
WHAT WE DO WITH YOUR INFORMATION
We require some personal information in order to fulfill our contractual agreement with all of our travelers. The information we collect is the minimum amount necessary in order to prepare a bespoke travel itinerary and make essential flight, accommodation and tour reservations on your behalf. Your information will be stored for internal record-keeping purposes on our secure servers. We will use your information to help us improve your experience and share inspiration for future journeys based on your interests. THIRD-PARTY DISCLOSURE
It is necessary for Neverseen to share your information with our contractors, service providers, and suppliers in order to fulfill our business obligations as a tour operator, as outlined above. Neverseen does not rent, sell or share the personal information we hold with any third-party organizations for the purposes of marketing products or services. Your data is never given to advertisers.
MEDIA RELEASE
In the event that Neverseen and/or its suppliers take photographs or digital recordings of you during any Neverseen travel package/event/activity, Neverseen will ask for your permission to share your experience with any and all media. Upon consent, you release to Neverseen all rights to exhibit this work in print and electronic form, publicly or privately. You waive any rights, claims, or interest you may have to control the use of your identity or likeness in whatever media used. You also understand that there will be no financial or other remuneration for recording you, either for initial or subsequent transmission or playback.
DISCRETION FOR PUBLIC FIGURES
In our commitment to ensuring the privacy and security of all our clients, including those who are public figures, we explicitly request our partners to exercise the highest level of discretion in all dealings. Recognizing the unique needs and preferences of our distinguished clientele, we offer the option for clients to request the use of a pseudonym throughout their trip. This measure is aimed at enhancing privacy and ensuring a serene and uninterrupted travel experience. Our partners are carefully briefed on the importance of respecting these privacy requests, ensuring that our clients’ identities are protected while still providing the exceptional service and experience Neverseen is known for.
